Interim Dean Banks Comments on Supreme Court Nominee Judge Garland
Judge Garland is an excellent choice for appointment to the Supreme Court. He is known as a non-ideological moderate, with a deep intellect and considerable experience as a judge on the D.C. Circuit Court of Appeals. He has been widely praised by Republicans and Democrats in the past, and he had a stellar career as a federal prosecutor before becoming a judge.
Just as President Obama had to meet his constitutional obligation to nominate a justice to the Supreme Court, the Senate has a constitutional responsibility to consider fairly this nomination. The partisan grandstanding masquerading as “letting the people decide” by deferring the appointment until after the November election is not prudent for the Court or the nation. There are dozens of important legal issues now on appeal to the Supreme Court that may be decided by a deadlocked 4-4 Court if the vacancy remains through this year. It is important for the nation and our highest Court to be able to function fully at this as any important time in our history.
